Client Information: Name, Phone, Email, Event Date, Venue, Pickup & Delivery, & Order Number. Local delivery is up to 10 miles; anything over 10 miles will incur an additional $0.25 per mile added to the final price. 

Order Summary: Your choice of cheesecake(s), your choice of cheesecake cupcakes & regular cupcakes, other desserts (optional), and your choice of flavors. Decorating instructions along with a subtotal of all costs provided to the "clients," sales tax, delivery & setup, a total provided, retainer fee given, and the balance due at the end. 

Reservation Fee: A 30% non-refundable retainer is required to reserve the event date. No order is reserved until the signed agreement and retainer are received. The Cheesecake Fix reserves the right to decline any order until both have been received. 

Final Payment: Due 21 days before the event. Returned checks will be charged a $35 processing fee plus any applicable bank charges. Late payments may incur fees only to the extent permitted by applicable Washington State law and any written agreement between the parties. 

No Refund Policy: Because cheesecakes, cheesecake cupcakes, and cupcakes are custom-made and production begins before the event, all payments are non-refundable after production has started. Failure to pick up an order does not create a right to a refund. 

Order Changes: Changes made within 14 days are not guaranteed. Additional work, specialty ingredients, premium flavors, or design revisions will result in an additional $45 charge. 

Venue Responsibilities: The Client "Buyer" is responsible for ensuring the venue provides adequate refrigeration when required, provides a stable-level display table, allows sufficient access for delivery, and has someone authorized to accept delivery. If venue staff move, cut, or alter the desserts AFTER delivery, The Cheesecake Fix is NOT responsible for any resulting damage. 

Delivery: Delivery fees include ONE delivery to ONE location.  Additional stops, waiting time, or setup beyond the agreed scope will incur a $50 charge. The responsibility transfers to the "Client - Buyer" or the venue representative once delivery is completed and accepted. 

Pickup Orders: The "Client - Buyer" assumes all responsibility for transportation and handling AFTER pickup. The Cheesecake Fix is NOT responsible for any damage that occurs after the order leaves its possession. 

Weather: Cheesecakes, cheesecake cupcakes, and cupcakes are highly temperature-sensitive. The Cheesecake Fix is NOT responsible for melting, softening, condensation, cracking, or structural changes caused by: Heat, Direct Sunlight, Outdoor Venue, Wind, Rain, Humidity, and Improper Refrigeration. 

Allergies: Products may contain or come into contact with milk, eggs, wheat, soy, peanuts, tree nuts, and gluten. The Cheesecake Fix will not guarantee an allergen-free product or environment. 

Fresh Flowers: All floral requests will be supplied by the client or the florist and placed as requested by the client. The Cheesecake Fix makes no representation that flowers are edible or food safe. 

Rental Equipment: Cake stands, dessert towers, cheesecake, cheesecake cupcakes, cupcake displays, pedestals, and serving equipment will be provided and paid for by "The Client - Buyer." The Cheesecake Fix does not supply any rental equipment. The return policy for rentals is 3 days. The Cheesecake Fix does NOT accept returns, and the "The Client - Buyer" is responsible for any damage to the rentals. The fees are the client's responsibility, NOT The Cheesecake Fix. 

Abandoned Orders: Orders not picked up by the agreed-upon time and date without prior arrangements will be discarded after the food safety time limits. All abandoned orders will NOT receive refunds, and deposits will NOT receive refunds. 

The "Client - Buyer": The client agrees to inspect the order upon pickup or delivery. Acceptance of the desserts confirms satisfaction with flavor, design, quantity, and condition. Claims regarding visible defects must be made BEFORE the desserts are accepted. 

Photography: The Cheesecake Fix will photograph all desserts for advertising, social media, printed materials, competitions, and its website. If the client wishes to request confidentiality in writing before the event. 

Acts Beyond Our Control: The Cheesecake Fix shall not be liable for delays or non-performance caused by events beyond its reasonable control, including severe weather, fire, natural disasters, utility outages, road closures, government actions, or serious illness. If performance becomes impossible for these reasons, remedies will be determined in a manner consistent with applicable laws and the circumstances, including consideration of payments already made and expenses reasonably incurred. 

Limitation of Liability: To the fullest extent permitted by law, The Cheesecake Fix's total liability under this "Agreement" shall not exceed the amount actually paid by the client. The Cheesecake Fix shall not be liable for indirect, incidental, consequential, or special damages, except where such limitations are prohibited by law/ 

Governing Law: This agreement shall be governed by the laws of the State of Washington. Any legal action arising from this agreement shall be brought in a court of competent jurisdiction in Washington, unless another venue is required by law. 

Entire Agreement: This document represents the complete agreement between "The Client - Buyer" and The Cheesecake Fix. No verbal statements or promises shall modify this agreement unless confirmed in writing and signed by both parties.
